Terms and Conditions
1. Program Overview
Fromuth Racquet Sports is pleased to offer qualified retail accounts access to lululemon athletica apparel through our wholesale distribution program. By placing any order for lululemon products through Fromuth Racquet Sports, you (the "Retailer") agree to be bound by the following terms and conditions in their entirety. These terms are in addition to Fromuth Racquet Sports' standard wholesale account agreement.
2. Custom Logo Requirement — Mandatory
ALL lululemon apparel purchased through Fromuth Racquet Sports must be ordered with a custom logo applied. This is a strict program requirement with no exceptions.
The following conditions apply to all Lululemon orders.
• Every unit of lululemon apparel must feature a custom logo representing your facility, club, academy, organization, or brand.
• Blank, undecorated lululemon apparel is NOT available for purchase through this program. Fromuth Racquet Sports will not fulfill orders for blank lululemon product under any circumstances.
• Logo artwork must be submitted and approved by Fromuth Racquet Sports prior to order processing. Approved file formats include: .AI, .EPS, .PDF (vector), and high-resolution .PNG (minimum 300 DPI).
• lululemon brand guidelines govern logo placement, sizing, and embellishment methods. Fromuth Racquet Sports reserves the right to reject artwork or logo placements that conflict with brand standards.
• Decoration methods (embroidery, heat transfer, screen print, etc.) are determined in consultation with Fromuth Racquet Sports and are subject to lululemon's approved embellishment guidelines.
• Minimum order quantities (MOQs) apply and will be communicated at time of quote. Custom logo orders cannot be returned or exchanged once production has begun.
The custom logo requirement exists to protect both the lululemon brand and the integrity of our authorized dealer network. Retailers who attempt to circumvent this requirement will have their lululemon purchasing privileges revoked.
3. Authorized Use & Resale
lululemon apparel purchased through Fromuth Racquet Sports is authorized for resale at your approved retail location(s) only, as designated in your account profile with Fromuth Racquet Sports. The following restrictions apply:
• Products may only be sold at the physical retail location(s) on file with Fromuth Racquet Sports.
• lululemon apparel may NOT be sold on Amazon, eBay, Walmart Marketplace, or any other third-party online marketplace.
• Retailers may not offer lululemon products for sale through any website, e-commerce platform, or social commerce channel without prior written authorization from Fromuth Racquet Sports.
• lululemon products may not be transferred, redistributed, or wholesaled to any third party.
• Retailers may not represent themselves as a direct lululemon partner, authorized dealer, or distributor. All branding and marketing related to the Lululemon program must be pre-approved.
4. Internet Sales Policy — lululemon
As an authorized distributor of lululemon apparel to the racquet sports specialty market, Fromuth Racquet Sports is obligated to comply with lululemon's policies regarding internet sales.
If Fromuth Racquet Sports is your lululemon supplier, it is for your retail shop only. You are strictly prohibited from selling lululemon products on Amazon, eBay, or any other internet site or online marketplace.
If it is determined that you are violating this policy, Fromuth Racquet Sports will be unable to continue supplying lululemon product to your account, per our agreement with lululemon athletica. Violations may also be reported to lululemon's brand protection team, which may result in further action at lululemon's discretion.
5. Pricing, Orders & Payment
• Wholesale pricing is provided at time of quotation and is subject to change. All prices are exclusive of applicable taxes, freight, and decoration charges.
• Decoration and logo application fees are invoiced separately and are non-refundable.
• Payment terms are per your existing Fromuth Racquet Sports account agreement. Orders will not enter production until payment or approved credit terms are confirmed.
• Fromuth Racquet Sports reserves the right to modify product availability, minimum order quantities, and pricing at any time with or without prior notice.
6. Returns, Exchanges & Defects
• All custom logo orders are FINAL SALE. No returns or exchanges are accepted on decorated apparel.
• In the event of a manufacturing defect or decoration error attributable to Fromuth Racquet Sports, we will work with you to provide a replacement or credit. Claims must be submitted within 10 business days of receipt of goods.
• Sizing, color, or style changes requested after production has commenced are not eligible for return or exchange.
7. Brand Compliance & Audit Rights
Fromuth Racquet Sports and/or lululemon Athletica reserve the right to audit retailer compliance with these terms at any time. This may include, but is not limited to:
• Reviewing online listings, social media, and third-party marketplace activity.
• Requesting documentation related to sales channels and distribution of lululemon product.
• Conducting in-person visits to approved retail locations.
Retailers found to be in violation of these terms may have their wholesale purchasing privileges suspended or permanently revoked without prior notice.
8. Governing Law & Amendments
These Terms and Conditions are governed by the laws of the Commonwealth of Pennsylvania. Fromuth Racquet Sports reserves the right to amend these terms at any time. Continued use of the lululemon wholesale program following notification of any amendment constitutes acceptance of the revised terms.
